1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Search Houses ("Search Houses", "we", "us", or "our") governing your access to and use of our home search, comparison, and evaluation tools and services. By accessing our website, using our services, or contacting us through any means, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately discontinue use of our services. We reserve the right to refuse service to anyone for any reason at any time.

2. SERVICE DESCRIPTION

We do not guarantee the accuracy, completeness, or timeliness of any property information, listings, or market data provided through our services. Property information is obtained from third-party sources and may be subject to errors, omissions, or changes without notice.

3. USER OBLIGATIONS

By using Search Houses services, you agree to:

Provide accurate, current, and complete information when registering for our services or communicating with us. You are responsible for maintaining the accuracy of your information and promptly updating any changes.

Use our services only for lawful purposes and in accordance with these Terms. You shall not use our services in any manner that violates any applicable federal, state, or local laws or regulations.

Maintain the confidentiality of any account credentials or access information provided to you and accept responsibility for all activities that occur under your account.

Not engage in any activity that interferes with or disrupts our services, servers, or networks, including but not limited to transmitting viruses, malware, or other harmful code.

Not attempt to gain unauthorized access to any portion of our services, other users' accounts, or computer systems or networks connected to our services.

Not reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without express written permission from Search Houses.

Not misrepresent your affiliation with any person or entity or falsely state or otherwise misrepresent your credentials or the purpose for using our services.

Conduct your own independent investigation and verification of any property information before making decisions based on information obtained through our services.

Understand that property availability, pricing, and details are subject to change without notice and may not reflect current status.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

When scheduling appointments or consultations with Search Houses:

Appointments may be scheduled by contacting us at Bryn.Hudson@searchhouses.info or through our designated scheduling system. All appointments are subject to availability and confirmation by Search Houses.

You are responsible for providing accurate contact information and being available at the scheduled appointment time. We are not responsible for missed appointments due to incorrect contact information provided by you.

If you need to cancel or reschedule an appointment, you must provide notice by contacting us at Bryn.Hudson@searchhouses.info. We request reasonable advance notice for cancellations, preferably at least 24 hours before the scheduled appointment time.

Search Houses reserves the right to cancel or reschedule appointments due to unforeseen circumstances, scheduling conflicts, or other operational needs. We will make reasonable efforts to notify you of any changes and work with you to find an alternative arrangement.

Repeated cancellations, no-shows, or failure to provide adequate notice may result in restrictions on future appointment scheduling or termination of service access.

Appointments are for the duration and scope agreed upon at the time of scheduling. Extended sessions or additional services may require separate arrangements and may be subject to additional fees.

5. PAYMENT TERMS

Certain services offered by Search Houses may require payment of fees. The following terms apply to all financial transactions:

All fees for services will be clearly communicated to you prior to your commitment to use such services. You agree to pay all applicable fees as described at the time of service selection.

Payment is due at the time specified in your service agreement. Accepted payment methods will be communicated to you and may include credit cards, debit cards, electronic transfers, or other methods as we determine.

All fees are quoted in United States Dollars unless otherwise specified. You are responsible for any currency conversion fees or charges imposed by your financial institution.

Fees are non-refundable except as expressly stated in a specific service agreement or as required by applicable law. If you believe you have been incorrectly charged, you must contact us at Bryn.Hudson@searchhouses.info within 30 days of the charge.

Search Houses reserves the right to modify service fees at any time. Fee changes will not affect services already purchased but will apply to future transactions. We will make reasonable efforts to notify users of fee changes.

Failure to pay fees when due may result in suspension or termination of access to services and may be referred to collections. You agree to pay all costs of collection, including reasonable attorney fees, incurred by Search Houses in collecting unpaid amounts.

Any promotional offers, discounts, or special pricing are subject to specific terms and conditions that will be communicated at the time of the offer and may not be combined with other offers unless explicitly stated.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEARCH HOUSES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use our services;

Any conduct or content of any third party on or through our services;

Any content obtained from our services;

Any property decisions made based on information obtained through our services;

Unauthorized access, use, or alteration of your transmissions or content;

Any real estate transaction or investment decision you make or fail to make;

Any errors, omissions, or inaccuracies in property listings, descriptions, or market information;

Any changes in property availability, pricing, or condition; or

Any dealings or interactions with property sellers, real estate agents, or other third parties contacted through our services.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF SEARCH HOUSES FOR ALL CLAIMS RELATING TO OUR SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO SEARCH HOUSES IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Search Houses shall not be liable for any failure or delay in performing services due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, telecommunications failures, internet outages, government actions, labor disputes, or third-party data provider failures.

You acknowledge that property search and evaluation involves inherent risks and uncertainties. Search Houses does not guarantee any particular outcome from using our services, including but not limited to finding a suitable property, securing favorable terms, or making a profitable investment.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

7. WARRANTY DISCLAIMERS

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SEARCH HOUSES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;

WARRANTIES THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;

WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY PROPERTY INFORMATION, LISTINGS, MARKET DATA, OR CONTENT PROVIDED THROUGH OUR SERVICES;

WARRANTIES THAT ANY PROPERTY SHOWN THROUGH OUR SERVICES WILL BE AVAILABLE, ACCURATELY DESCRIBED, FAIRLY PRICED, OR SUITABLE FOR YOUR PURPOSES;

WARRANTIES REGARDING THE QUALITY, CONDITION, LEGAL STATUS, OR INVESTMENT POTENTIAL OF ANY PROPERTY;

WARRANTIES THAT USE OF OUR SERVICES WILL RESULT IN FINDING A PROPERTY, COMPLETING A SUCCESSFUL TRANSACTION, OR ACHIEVING ANY PARTICULAR OUTCOME.

Search Houses does not warrant or guarantee that property information obtained from third-party sources is accurate, complete, or current. Property listings, prices, descriptions, photographs, and availability are subject to change without notice and may contain errors or omissions.

We do not conduct independent verification of property information unless expressly stated. Property data, including square footage, lot size, room counts, amenities, age, condition, tax information, and other details, is provided by third parties and should be independently verified by you.

Search Houses does not guarantee that our services will meet your specific requirements or expectations. We do not warrant that any defects in our services will be corrected or that our systems are free from security vulnerabilities.

You acknowledge that real estate markets are complex and dynamic, and that any market analyses, trends, or predictions provided through our services are estimates based on available information and should not be relied upon as guarantees of future performance.

Any content, advice, or opinions expressed through our services represent general information only and should not be construed as professional advice specific to your circumstances.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with applicable federal laws and the laws of the jurisdiction in which Search Houses operates, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be subject to resolution through the following process:

Informal Resolution: Prior to initiating any formal proceedings, you agree to contact us at Bryn.Hudson@searchhouses.info to attempt to resolve the dispute informally. We commit to working with you in good faith to reach a mutually satisfactory resolution.

If informal resolution is unsuccessful within 30 days, either party may pursue formal legal remedies available under applicable law.

You agree to bring any claims on an individual basis only and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Class arbitrations, class actions, private attorney general actions, and consolidation with other proceedings are not permitted under these Terms.

Each party shall bear its own costs and attorney fees unless otherwise awarded by a court of competent jurisdiction or as required by applicable law.

Any claim or cause of action arising out of or related to use of our services or these Terms must be filed within one year after such claim or cause of action arose, or it shall be forever barred, regardless of any statute or law to the contrary.

9. INTELLECTUAL PROPERTY

All content, features, functionality, designs, logos, text, graphics, software, and other materials available through Search Houses services are owned by Search Houses, its licensors, or other content providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:

Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or materials obtained from our services;
